THE RULES OF COMPLETING MISSING DOCUMENTS IN PENDING PROCEEDINGS - TRC

The documents in pending proceedings ought to be completed in accordance with the contents of the requests received from the Office on the conditions and within the terms specified therein. We ask for reading the contents of the letters received from the Office carefully.

 

COMPLETING FORMAL DEFICIENCIES  OF AN APPLICATION  

 

  • After receiving a request issued on the basis of art. 64§2 of the Administrative Procedure Code to complete the formal deficiencies of an application (e.g. a photocopy of the passport with the original for inspection, completing the application in the indicated parts, annex no. 1 to the application, personal appearance), the required documents must be submitted personally at the registered office of the Department for Foreigners’ Affairs at ul. Marszałkowska 3/5 in Warsaw in room 25 (desk 14) after collecting a ticket with  the letter ”C,” showing the letter received.

The documents ought to be submitted within the non-negotiable term given in the request (including off-work days). In the event of a failure to complete  all the required documents or completing the wrong ones within the indicated term, an application may be left without processing. In the event of not observing the term indicated or a notification about leaving an application without processing, it is possible to submit a written request for reinstating the term for completing the formal deficiencies of an application.

 

While submitting a request for reinstating the term for completing the formal deficiencies of an application, one ought to fulfil 4 premises JOINTLY:

1.  submitting a written request for reinstating the term (with an original, legible signature)

2. submitting a request within the term not longer than 7 days from the day of the cessation of the reason for which delivering the required documents within the required term has not been possible  

3. a written explanation of the reason for not completing the documents indicated in the request within the required term in the contents of the request for reinstating the term 

4. submitting the required documents indicated in the request with the request for reinstating the term (including the confirmation of personal appearance)

 

The request for reinstating the term with the required documents and the necessity of  personal appearance ought to be completed in room 25 (desk 14) after collecting a ticket with the letter ”C,” showing the notification received about leaving the application without processing.

Completing missing documents or a letter with a request for reinstating a term with the required documents can be also submitted through the Registry Office (desk 8, after collecting a ticket with the letter “A”) or through the Customer Service Point of  Mazowiecki Urząd Wojewódzki in Warsaw, Pl. Bankowy 3/5, entrance F from Al. Solidarności. The documents submitted in this way are not subject to verification; and they are not certified to be compliant with the original.

 

COMPLETING SUBSTANTIVE DEFICIENCIES OF AN APPLICATION   

 

In the course of the proceedings regarding the case of issuing a residence permit, the Office may request a Foreigner to complete the documents necessary to confirm the circumstances indicated in the application.

The documents ought to be submitted within the term indicated in the letter. In the event of a failure to submit the required documents, the decision shall be issued on the basis of the evidence collected in the case.

  • Supplementing missing documentation takes place in person or by a proxy  in the registered office of  the Department for Foreigners’ Affairs at ul. Marszałkowska 3/5 in Warsaw – the Entresol, room A08 (desk no. 18), only after a prior appointment through THE INTERNET CALENDAR available through the link in the application for tracking the case status (the link redirects to the queue where one can obtain a ticket with the letter “B” directly; the "B" number is not available in the ticket machines at the Department’s registered office). During an appointment, documents in a specific case only will be accepted through the status of which the reservation has been made.

You have received the login and password for the application at the time of submitting the application at the office. The persons who have sent applications by mail  shall receive the login and password with a letter requesting the completion of formal deficiencies. The persons who do not have a login and password can obtain it by sending an inquiry through the contact form.

In administrative proceedings, a copy of a document does not constitute evidence; original documents or copies certified by a notary public for compliance ought to be submitted with the original. Documents in a foreign language ought to be submitted together with their translation into the Polish language made by a Polish sworn translator. When completing documents, you must present a request, registration confirmation, and show the originals of the documents mentioned with their copies to be attached to the case files.

The copies of submitted documents can be certified to be true copies by an employee of the Office during an appointment only.

 

  • The originals of documents or their copies confirmed by a notary can also be submitted without an appointment through the Registry Office of the Department  at ul. Marszałkowska 3/5 in Warsaw (the ground floor, desk 8, after collecting a ticket with the letter “A”), sent through post or through the Customer Service Point  of  Mazowiecki Urząd Wojewódzki in Warsaw, Pl. Bankowy 3/5, entrance F from Al. Solidarności.

The documents submitted in this way are not subject to verification and are not certified to be true copies. 

 

At the same time, we inform that there is no possibility of  completing  substantive deficiencies collecting  a ticket with the letter  “C.”

  

SUBMITTING ADDITIONAL DOCUMENTS

 

  • Additional documents without a request (e.g. information on the change of a correspondence address) can be submitted through the Registry Office of the Department at ul. Marszałkowska 3/5 in Warsaw (the ground floor, desk 8, after collecting a ticket with the letter “A”), sent through the post or through the Customer Service Point of  Mazowiecki Urząd Wojewódzki in Warsaw, Pl. Bankowy 3/5, entrance F from Al. Solidarności.
